Sometimes a person is unable to manage their own financial affairs perhaps because of physical difficulties or in some cases because of mental incapacity. Often a relative has to step in to assist. At this difficult time, Lovegroves LLP can help clients by providing legal guidance such as:

If the person requiring assistance still has sufficient mental capacity then they can make a Lasting Power of Attorney for Property and Affairs appointing an Attorney of their own choice to assist them with managing their financial affairs. Lovegroves LLP can assist with all aspects from initial instructions to registration with the Office of Public Guardian.

Has the person requiring assistance made an Enduring Power of Attorney or a Lasting Power of Attorney already? If yes, then we can assist with the registration process if it is required and advise Attorneys with regard to the use of the document and their obligations and duties.

If the person requiring assistance has already lost mental capacity when help is needed and they did not make an Enduring Power of Attorney or Lasting Power of Attorney prior to losing capacity, then an application will need to be made to the Court of Protection in order for the Court to make decisions on that person’s behalf. In particular a family member may apply to be appointed as a “Deputy” for the person concerned so that they can manage the person’s financial affairs on their behalf under Court supervision.

Has the person lost the mental capacity to manage their personal welfare? If the person previously made a Lasting Power of Attorney for Personal Welfare then we can assist Attorneys with its registration and use. If there is no Lasting Power of Attorney for Personal Welfare then an application to the Court of Protection will need to be made and again we can assist.

We cannot stress how important it is for people to take proper legal advice in such situations and to act promptly. At Lovegroves LLP we will provide relevant and practical guidance in a sensitive manner.

In particular Lovegroves would advise all our clients to consider making Lasting Power of Attorney documents so that if they should lose physical and/or mental capacity in the future, they have appointed suitable Attorneys to help them. This helps ensure that family and friends are able to assist you quicker and with less expense to you in the future as well as helping to relieve your family and friends of additional stress at a difficult time.
